Terms of Use

1. Agreement to Terms

By accessing this website and utilizing the web development, SEO, or digital marketing services provided by HM Hisham Ahmed ("Developer," "I," or "Me"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you are prohibited from using this site and our services.

2. Services & Scope of Work

All freelance services, including but not limited to custom HTML/CSS development, React.js applications, Google/Meta Ads management, and Technical SEO, will be clearly defined in a separate Statement of Work (SOW) or project proposal provided to the client.

  • Any requests outside the agreed-upon scope of work will be subject to additional fees.
  • Timelines provided are estimates and depend on the client's prompt delivery of required assets, copy, and feedback.

3. Payment Terms

Standard payment terms for project-based work require a non-refundable upfront deposit (typically 50%) before any development or strategy work begins. The remaining balance is due upon project completion, prior to the transfer of files, launching the website, or handing over ad accounts.

For monthly retainer services (such as ongoing SEO or Social Media Management), invoices are due upon receipt at the beginning of each billing cycle.

4. Intellectual Property Rights

Upon final payment, the client assumes full ownership of the final deliverables (e.g., website code, ad graphics, compiled copy). However, the Developer retains the right to:

  • Display the completed project in their digital portfolio, case studies, and social media for promotional purposes.
  • Retain ownership of any custom libraries, internal tools, or base codebases used to construct the project.

5. Client Responsibilities

You agree to provide accurate, current, and complete information necessary for the execution of the services. You guarantee that any elements of text, graphics, photos, designs, or trademarks provided to the Developer are owned by you, or that you have permission to use them.

6. Limitation of Liability

In no event shall HM Hisham Ahmed be liable for any indirect, consequential, or special damages arising out of the use or inability to use the materials on this website or the digital services provided. This includes, but is not limited to, loss of data, loss of revenue, or ad spend discrepancies on third-party platforms (e.g., Google or Meta).

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising in connection with these terms or the services provided shall be subject to the exclusive jurisdiction of the courts located in Mangaluru, Karnataka.
